AEO Certification in India 2026 for Importers and Exporters: What It Is, Whether You Qualify, and How It Changes Your Clearance

Most importers who ask us about AEO certification start with the wrong question. They want to know how to apply. The better question is whether your last three years of customs records would hold up under review, because that's what AEO really checks.

Short answer: What is AEO certification in India in 2026?

AEO certification is CBIC's trusted trader status for businesses in the international supply chain, run under Circular 33/2016-Customs. Importers and exporters can hold one of three tiers, T1, T2 or T3, while AEO-LO covers logistics providers. Benefits grow with each tier, from bank guarantees cut to 50% at T1 to deferred duty payment at T2 and T3, which has worked on a 30-day cycle since 1 March 2026. To qualify, you generally need three financial years of business, at least 25 Bills of Entry or Shipping Bills last year and a clean compliance and solvency record.

Deferred duty payment: the benefit your CFO will notice

Under Section 47 of the Customs Act and the Deferred Payment of Import Duty Rules, AEO T2 and T3 importers can clear goods first and pay duty later. Budget 2026 doubled the deferral period from 15 to 30 days, effective 1 March 2026. Duty on Bills of Entry returned during a month is now due by the 1st of the next month. March is the exception, when duty is due by 31 March. On the Bill of Entry, you select D instead of T.

Here's what that can mean in cash. Say you pay ₹2 crore of import duty a month, spread evenly. On average, that money stays with you for about 15 days each month. At a 9% cost of funds, that's roughly ₹74,000 a month, or close to ₹9 lakh a year, before you count anything else. These figures are illustrative, and your actual cost depends on your duty volume and borrowing cost.

Bank guarantees and automated clearance

Lower bank guarantees free up working capital. If your guarantee would normally be ₹1 crore, a T2 importer furnishes ₹25 lakh and a T3 importer furnishes none. MSMEs get a deeper cut under Circular 54/2020-Customs, with 25% at T1 and 10% at T2.

Automation is the other 2026 story, and it's more nuanced than most guides suggest. CBIC's Circular 01/2025 first gave AEO T2 and T3 importers automated out-of-charge. Then Circular 06/2026, issued on 1 February 2026, extended auto out-of-charge to all importers where duty is paid and no compliance requirement applies. It also introduced automatic goods registration on arrival for AEO T2 and T3 entities, Eligible Manufacturer Importers and importers using direct port delivery.

So auto clearance is no longer an AEO-only perk. What AEO still gives you is the full package working together: deferred duty, smaller guarantees, fewer seal and scanning checks, and automatic registration.

Other agencies are moving too. Under the National Time Release action plan, FSSAI and WCCB extend facilitation to all AEO tiers, and CDSCO has started recognising AEO-T3.

Every AEO benefit rests on clean filings. See how XEMI Clear validates each Bill of Entry and Shipping Bill before it reaches ICEGATE.

Do You Qualify? AEO Eligibility for Importers and Exporters

AEO isn't graded on size. It's graded on track record. Here's what CBIC checks under Circular 33/2016, with the MSME relaxations from Circular 54/2020.

Requirement

Standard applicant

MSME applicant (T1 and T2)

Business history

3 financial years

2 financial years

Bills of Entry or Shipping Bills filed in the last financial year

25

10, with at least 5 in each half-year

Compliance record

No show cause notice involving fraud, smuggling or similar serious violations in the last 3 financial years, and no prosecution

Same test, over 2 financial years

Financial solvency

3 years, backed by audited accounts

2 years

Processing time after a complete application

About 1 month for T1 and 6 months for T2

15 working days for T1 and 3 months for T2

T2 adds a documented security plan and an on-site verification by the AEO Programme Team. T3 needs at least two years of continuous T2 status, and your key business partners should hold T2, LO or an equivalent foreign AEO status.

A 10-point AEO readiness check

Answer these honestly before you apply. If you hesitate on more than two, fix those gaps first.

1.      Have we been in customs-related business for at least three financial years, or two if we're an MSME?

2.     Did we file at least 25 Bills of Entry or Shipping Bills last financial year, or 10 if we're an MSME?

3.     Can we show there's been no show-cause notice involving fraud or smuggling in the last three years?

4.     Were our accounts audited and solvent in each of those years?

5.     Can we pull every Bill of Entry, Shipping Bill and supporting document from those years in minutes instead of weeks?

6.     Do our HSN codes match across the ERP, the invoices and the customs filings?

7.     Do we have a written process to spot errors and disclose them to Customs?

8.    Can we show who prepared and approved each filing, and when?

9.     For T2, do we have a site security plan and access controls we could walk an officer through?

10.  Do our CHA and logistics partners share documents through a traceable system, or through email and WhatsApp?

Questions 5 to 8 are where most applications slow down. The paperwork exists, but it's scattered across mailboxes, shared drives and the CHA's records, and pulling three years of it together becomes a project of its own.

If questions 5 to 8 made you pause, that's the gap XEMI is built to close.

Why AEO Is Worth More in 2026, and What It Won't Do for You

The direction is clear. India is moving clearance toward trusted, automated lanes, and the Budget made the incentive explicit. Its new Eligible Manufacturer Importer category gives non-AEO manufacturers deferred duty only until 31 March 2028, a deliberate nudge toward full AEO status.

The planned Customs Integrated System adds another reason. The Budget announced it for rollout within two years, with procurement reports pointing to April 2027, and it's expected to bring ICEGATE, RMS and ICES onto one AI-enabled platform. CBIC hasn't said how AEO status will feed its risk models, so treat any claim that it does with care. But a clean, consistent filing history is exactly the kind of data a risk engine is designed to reward, and AEO is the formal proof of that history.

AEO also travels. India has AEO mutual recognition agreements with South Korea, Hong Kong, Taiwan, the US, the UAE, Australia and Russia, as CBIC reported in May 2025, and T2 and T3 holders get recognition in those markets.

Now the honest part. AEO doesn't exempt you from post-clearance audit, and officers can still place a hold on intelligence grounds, even on automated clearances. It can also be revoked. Under para 5.7.1(iii) of Circular 33/2016, a show cause notice involving fraud can lead to revocation, and contested demands can come up again at renewal. Certification is a status you keep earning.

How to Apply for AEO Certification in India, Step by Step

1.      Choose your target tier and check eligibility against Circular 33/2016, and Circular 54/2020 if you're an MSME.

2.     Prepare the annexures on general compliance, legal and commercial records, and financial solvency, plus the security annexure for T2 and LO.

3.     Apply online through the AEO India portal at aeoindia.gov.in.

4.     Respond quickly to any deficiency notice, which CBIC aims to issue within 30 days.

5.     For T2 and LO, host the on-site verification by the AEO Programme Team.

6.     Receive your certificate and put the renewal date in the calendar: three years for T1 and T2, five for T3 and LO.

Customs and Trade Compliance Software India: How XEMI Helps You Get AEO-Ready and Stay That Way

XEMI doesn't issue or guarantee AEO status. That decision belongs to CBIC. XEMI builds the record AEO reviewers look for as a by-product of your team's everyday work.

XEMI is an AI-powered trade collaboration platform for importers, exporters, CHAs and freight forwarders. For a trade compliance team, it works like this:

  • Every Bill of Entry and Shipping Bill is validated field by field before filing, and XEMI's HSN 360 engine recommends classification with a confidence score, so errors don't enter your compliance history in the first place.
  • Every action, approval and correction is timestamped against the shipment, giving you the trail behind questions 7 and 8 of the readiness check.
  • XEMI Vault keeps seven years of trade documents, so a three-year lookback takes minutes.
  • Your CHA, finance team and logistics partners work on the same shipment record, not on separate email and WhatsApp threads.
  • Two-way sync with SAP and Oracle keeps your ERP and customs data consistent, which is what question 6 tests.

Customs audit management software that's already running

The real value shows up at audit time, whether that's an AEO review, a renewal or a post-clearance audit. Teams don't scramble to rebuild a story from scattered files, because the record already exists.

100% customs audit pass rate

That's the first-year audit pass rate XEMI customers report.

For import teams in India, this sits inside XEMI's import management software alongside tracking and landed cost. For exporters, it connects to Shipping Bill filing and incentive tracking. And if you move fewer than five shipments a month, a careful spreadsheet and a good CHA may be all you need for now.

See how XEMI keeps your filings AEO-ready, every shipment, every year.
